BookPoint Terms and Conditions

Effective Date: 6th October 2025

By accessing or using BookPoint services, you agree to be bound by these Terms and Conditions ("T&C"). If you do not agree, do not use the platform.

1. Definitions

  • BookPoint / we / us / our: BookPoint Digital Solutions Limited, its affiliates, and licensors.
  • Platform: BookPoint mobile apps, web app, APIs, and related services.
  • Customer: A user booking services through the Platform.
  • Service Provider: Registered businesses or individuals providing services via the Platform.
  • Booking / Appointment: A request placed by a Customer for a specified service at a specified time.
  • Commission: The fee charged by BookPoint on successful bookings.

2. General Terms for All Users

  • Acceptance of Terms: By creating an account or using BookPoint, you accept these T&C.
  • Eligibility: Users must be at least 18 years old and capable of entering into binding contracts under Nigerian law.
  • Accounts & Security: Provide accurate, up-to-date information. Keep login credentials confidential. Notify BookPoint immediately of unauthorized access.
  • Changes to Terms: BookPoint may update T&C; continued use constitutes acceptance.

3. Customer App – Terms for Customers

3.1 Booking and Service Flow

  • Customers may search for services, view availability, and place bookings.
  • Bookings are subject to Service Provider availability. BookPoint facilitates bookings but does not provide the services directly.

3.2 Pricing & Payments

  • Prices include Service Provider-set service price and any BookPoint fees.
  • Customers authorize BookPoint (or payment partner) to charge selected payment methods.
  • Payments are processed via third-party processors; BookPoint does not store card details.

3.3 Cancellations & Refunds

  • Cancellation rules are set by the Service Provider and displayed at booking.
  • For disputes (no-shows, poor service), contact BookPoint support; mediation, credits, or refunds may be offered.

3.4 Customer Conduct

  • Customers must not misuse the Platform, harass staff, or manipulate reviews/bookings.
  • BookPoint may suspend or terminate accounts for prohibited conduct.

4. Service Provider App – Terms for Service Providers

4.1 Onboarding & Verification

  • Service Providers must complete onboarding, provide valid documents, and accept the Service Provider appendix.
  • Service Providers represent they are authorized to provide listed services and comply with applicable laws.

4.2 Service Availability & Fulfillment

  • Service Providers must honor bookings and ensure staff/resources are available.
  • If unable to fulfill a booking, cancel promptly; penalties or customer refunds may apply.

4.3 Commission, Fees & Payments

  • Commission rates and payout schedules are set in the Service Provider appendix and Business dashboard.
  • Payouts are subject to verification, deductions (refunds, chargebacks), and taxes.
  • BookPoint may hold funds temporarily for investigation or disputes.

4.4 Taxes

Service Providers are responsible for all taxes arising from using the Platform. Prices displayed must include applicable taxes.

4.5 Reviews & Ratings

  • Service Providers must not manipulate ratings or solicit fake reviews.
  • BookPoint may remove reviews violating policies.

4.6 Obligations & Prohibited Items

  • Services must be professional; any restrictions, extra fees, or prerequisites must be disclosed.
  • Illegal services/items are prohibited.

5. Refunds, Disputes & Liability

  • BookPoint takes responsibility for providing the platform and its services, making reasonable efforts to ensure availability.
  • BookPoint is not liable for indirect, incidental, or consequential losses, including lost profits or data.
  • Liability for direct damages is limited to the amount paid for the affected service.
  • Nothing excludes liability for death, personal injury, or obligations that cannot be excluded under Nigerian law.
  • Users agree to indemnify BookPoint for claims arising from misuse or violation of T&C.

6. Intellectual Property & Content

  • BookPoint and licensors retain IP rights for the Platform.
  • Service Providers grant BookPoint a non-exclusive license to display their content (name, images, menus, prices, reviews).
  • Users must not upload unlawful, infringing, or offensive content.

7. Privacy & Data

  • Governed by the BookPoint Privacy Policy.
  • BookPoint may aggregate anonymized data for analytics, product improvements, and reporting.

8. Termination & Suspension

  • Users may close accounts, subject to obligations like accepted bookings.
  • BookPoint may suspend or terminate accounts for policy violations, fraudulent activity, or law violations.

9. Dispute Resolution & Governing Law

  • Governed by the laws of the Federal Republic of Nigeria.
  • Disputes should first be raised with BookPoint support; unresolved disputes go to Nigerian courts or arbitration if agreed.

10. Third-Party Services

  • The platform may use third-party services (payment processors).
  • Users should review third-party terms and privacy policies.

11. Miscellaneous

  • Severability: If any provision is unenforceable, remaining provisions remain valid.
  • Changes: BookPoint may update these T&C; continued use constitutes acceptance.

Service Provider Agreement Appendix

Effective Date: 6th October 2025

  • Services: Service Providers must provide listed services and fulfill bookings professionally and lawfully.
  • Onboarding & Verification: Accurate documents required; BookPoint may suspend payouts during verification.
  • Commission & Fees: Standard commission as agreed between BookPoint and Service Providers.
  • Payouts & Holds: Regular schedule; temporary holds for disputes/fraud deductions may apply for refunds/chargebacks/taxes.
  • Cancellations, No-shows & Penalties: Notify BookPoint promptly; repeated failures may lead to penalties or higher commission.
  • Refunds & Chargebacks: Service Providers handle refunds per BookPoint procedures; chargebacks may be deducted from payouts.
  • Data, Reporting & Confidentiality: Booking data and analytics provided; confidential info must not be shared or reused competitively.
  • Compliance & Insurance: Comply with laws, maintain licenses, and insurance as required.
  • Term & Termination: Agreement continues until terminated; BookPoint may suspend/terminate for breach, fraud, illegal activity, or poor service.
  • Indemnity & Limitation of Liability: Service Providers indemnify BookPoint; aggregate liability limited to commission fees paid in previous three months unless law requires otherwise.
  • Dispute Resolution & Governing Law: Nigerian law; disputes raised with support first, then courts or arbitration if agreed.
